    California Notary Law: What Signers Should Know

    California has some of the strictest notary laws in the country. Here's what you need to know before your appointment.

    Personal Appearance Required

    California law requires the signer to physically appear before the notary. No remote or online notarizations are currently permitted.

    Fee Cap: $15 Per Signature

    California sets a maximum fee of $15 per notarized signature. Notaries may charge separate fees for travel (mobile fee), printing, or waiting time.

    Thumbprint Required

    For real property documents and Powers of Attorney, California law (Gov. Code §8206) requires the signer's thumbprint in the notary's journal.

    Official Journal Kept

    Every California notary must keep a sequential journal of all notarial acts. This journal is a legal record and may be subpoenaed.

    Acceptable ID

    Driver's license, passport, state ID, military ID, or credible witness oath. Expired ID is not accepted.

    Commission Term: 4 Years

    California notary commissions are valid for 4 years, issued by the Secretary of State. Always confirm your notary's commission is active.

    $15,000 Surety Bond Required

    Every California notary must hold a $15,000 surety bond filed with their county clerk — providing limited public protection.

    No Online Notarization Yet

    SB 696 authorized future RON in California, but implementation is not expected before 2030. All signings are in-person.
