New Hampshire has a distinctive notary framework with Governor and Council appointment, three-endorsement requirement, statutory travel fees, and RON authorization. Here's what to know.
Personal Appearance Required (In-Person)
For traditional in-person notarizations, the signer must physically appear before the notary. RON allows remote appearance via compliant audio-video technology since February 2022.
Fee Cap: $10 Per Act
New Hampshire caps notary fees at $10 per notarial act. For depositions, the fee is $5 per act up to $50 total. A statutory travel fee of $0.20 per mile applies for travel to swear in witnesses.
No Bond Required
New Hampshire does not require a surety bond for notary commissions. Notaries are personally liable for errors, and E&O insurance is strongly recommended.
Three Endorsements Required
New Hampshire notary applicants must obtain endorsements from two current New Hampshire Notaries Public in good standing and one New Hampshire registered voter — attesting to the applicant's character and fitness for the commission.
Governor and Council Appointment
New Hampshire notaries are appointed by the Governor with the advice and consent of the Executive Council — a higher level of governmental oversight than most states. The process takes 8-10 weeks.
Commission Term: 5 Years
New Hampshire notary commissions are valid for 5 years. All notarial authority ceases at midnight on the expiration date — there is no grace period.
