    Personal Appearance Required (In-Person)

    For traditional in-person notarizations, the signer must physically appear before the notary. RON via Electronic Notary registration allows remote appearance since January 2023.

    Fee Cap: $2 Per Act — Lowest in Nation

    New York caps notary fees at $2 per notarial act — the lowest statutory cap in the United States. A 2025 bill proposed raising this to $5 but had not passed as of mid-2025. Mobile travel fees and signing agent fees are separate.

    No Bond Required

    New York does not require a surety bond for notary commissions. However, many NY notaries obtain optional $10,000 bonds for professional protection. E&O insurance is strongly recommended.

    Written Exam Required

    New York requires all notary applicants to pass a written exam. The exam covers New York notary law, proper notarial procedures, and the notary's duties and limitations.

    Journal Mandatory Since January 2023

    Effective January 25, 2023, all New York notaries must keep a mandatory journal of all notarial acts — a significant change from prior law. Journals must be retained for 10 years.

    Commission Term: 4 Years

    New York notary commissions are valid for 4 years, issued by the Department of State. Notaries must also file their commission with the county clerk in the county where they reside or have their principal office.

    New York RON requires separate Electronic Notary registration via NY Business Express, submission of an electronic exemplar, and use of a compliant platform per 19 NYCRR Part 182. The notary must be physically in New York.

    County Clerk Filing Required

    New York notaries must file their commission with the county clerk in their county of residence or principal office. This county-level filing enables local verification of commission status.
